CONDITIONS: this is an individual (not group) piece of assessment. You should complete every aspect of this Take Home Exam by yourself (i.e. identification of issues, analysis and writing). Please do not discuss with your class mates. You should not ask for help from your lecturer or tutors.

EXPECTATIONS: a good understanding of relevant class materials (lectures, tutorials), as well as consultation with relevant parts of the prescribed text (you need to identify what may be relevant) is sufficient to complete this assessment. You do not need to undertake additional research (that is optional). Your mark will depend on how well you have identified relevant issues and principles, and how well you have applied the principles to the facts (remember to cite case authorities).

SUBMISSION: all Take Home Exams must be submitted in hard copy to the RSA School Office, HN 2037. Please attach a RSA coversheet to your Take Home Exam and include your tutor’s name and your tutorial time on the front coversheet. Coversheets are available at the RSA School Office.

Southern Oil (Southern) is a manufacturer of petroleum and natural gas products. Southern acquired a large block of land in NSW for the purpose of building a petrol station, which would be leased to another party. The block was on a very busy street. The block of land already contained a multi-storey restaurant which fronted (faced) the street. Southern intended to build the petrol station next to the restaurant, such that the petrol station also faced the street.
