The Nature of Agency Video illustrates Non-Linear Pro legal action suit against Quick Takes Video for apparent breach of contract. The companies met but each left believing a different business decision. The misunderstand led Janet a Quick Takes Video employee to signed what she thought was a package delivery confirmation slip for the Non-Linear Pro equipment upon its arrival. However, in actuality Janet signed Quick Takes Video into a three-month lease agreement for Non-Linear Pro’s editing equipment. This paper will review Janet’s implied or expressed authority that entered Quick Takes Video and Non-Linear Pro into contract with each other as presented in the Nature of Agency Video.
Upon arrival of Non-Linear Pro’s editing equipment Quick Takes Video employee Janet signs what is believed to be a delivery confirmation slip. Unbeknown to Janet she signed Quick Takes Video into a three-month lease agreement for Non-Linear Pro’s editing equipment with an assumed payment due at the end of the lease. Quick Takes Video attempted to use Non-Linear Pro’s editing equipment for weeks unsuccessful. Quick Takes Video employees spend several unsuccessful hours reviewing the manual and attempting to train each other on the equipment. Hence, Quick Takes Video employees recommended the discontinued use of Non-Linear Pro’s editing equipment and executives Hal and Karen authorized the equipment’s return to Non-Linear Pro. Non-Linear Pro receives the editing equipment but without payment as noted in the terms of the lease agreement. Therefore, Non-Linear Pro files suit against Quick Takes Video for breach of contract as the equipment was returned before the lease expired and without the lease agreement payment.
Quick Takes Video executives believe Non-Linear Pro has no legal standings to hold them to a lease agreement when they only agreed to use Non-Linear Pro’s editing equipment on a trail bases. Further, Quick Takes Video claims their employee Janet is neither an owner nor a partner of the company with no authority to bind the company to any lease contracts and corresponding obligation of payment.
