Castulon Corporation should establish a drug testing program. An employee using illegal drugs is almost 4 times more likely to be involved in a job related accident then an employee who does not use illegal drugs. Castulon Corporation is aware there are employees are using drugs. If they do nothing and someone is hurt this could be huge liability for the Corporation. One incident alone could tarnish the company’s reputation in the electronics industry.

Castulon Corporation should be proactive in their drug testing program and look at other corporations and their drug testing policy. A committee of employees, management and legal counsel should then massage the policy so that it fits the Castulon Corporation. Castulon Corporation should make every effort to include the employees in this process so they understand the company wants to help those that use drugs and not punish the employees that do not use drugs. The employee should be made aware that drug testing is strictly looking for drugs and the results do not indicate any health problems to the employer. The drug testing should be done by a qualified and reputable third-party to ensure accurate results and medical confidentiality. Confidentiality between the employee and employer should be maintained at all times. They should establish a training program for supervisors and management on how to identify drug use.

The employees that fit the criteria of drug use would be asked to submit to a drug test. The drug test should be one that is reliable and least invasive of privacy of the individual. If the drug test comes back positive the employee shall submit to a second drug test to confirm the results of the first. If the second drug test confirms drug use than the employee would be given the options of being fired or entering a drug rehabilitation program. If the employee chooses to enter a drug rehabilitation program they must successfully complete the program in order to keep their job. If the employee quits drug treatment program before completion they will be terminated.

Upon successful completion of a drug rehabilitation program the employee will be fully reinstated to their former position or one of equal pay and ranking. If the employee successfully passes future drug test within a probationary period of one year of returning to work the previous offense will be removed from the employees file for evaluation purposes.

In addition to training supervisors and management to identify drug use or drug problems there will be a random drug testing policy in place. All employees will be subject to a random drawing of names to take a drug test. No employee shall have to subject themselves to random drug tests more than two times a year unless the drug test has indicated drug usage. At no time will a supervisor or member of management use the random drug testing policy to harass, annoy or any other action that is detrimental
