Challenges of Advocacy and Mediation

The reason for this paper will be exploring the ethical, moral, and legal challenges of potential dual relationships as an advocate or mediator. The author will also give a personal perception of the integration of advocacy and mediation within the human services field. The author will also identify personal philosophy and individual approach to advocating and mediating within a specific setting, such as The Mediation Institute of Tulsa will also be evaluated.

Challenges of Dual Relationships

A mediator is a professional conflict resolver; he or she is impartial to a party of two or more people who need help to reach an agreement or conclusion to an issue. A mediator is an alternative to litigation to solve disagreements. The mediator does not make the decisions but helps the party come to an agreement. The final conclusion is decided by the two parties. It is the mediator’s responsibility to keep the interactions confidential and private unless otherwise specified (wiseGeek, 2012).

A mediator needs to be neutral when helping people work through their issues. This may not always be easy because the mediator’s beliefs, and values may not agree with others. Even though this may be a challenge a mediator will have to keep the integrity during the mediation. As a mediator one faces legal, ethical, and moral issues every day. If a mediator does not stay neutral and one or both of the parties involved feel uncomfortable they may seek the advice of another mediator.

Personal Perception

Many people in society do not know what their rights are when it comes to civil or legal matters; this is why a mediator is important to the human services field. People many not know about the laws that are set forth to protect them and so this is where mediators and advocates can fill the gap. Mediators are communication mediums between two parties who have conflict so without them people may continue living life unsatisfied because their needs have not been met.
