Mr.Phuc official announced that they sued to Ba Huan Private Enterprise at People's Court of Ho Chi Minh city. In this document, Mr.Phuc exposed that Ba Huan Private Enterprise serious violated intellectual property rights on technology transfer. In this contract on 22/03/2007 between Mr.Phuc and Ba Huan Private Enterprise by Pham Thi Ba Huan (Pham Thi Kim Anh signed a contract representative) and testimony by the parties at the trial of the Doan Minh Phuc said that the technology transfer process duck eggs for Ba Huan private enterprises that deal is 40,000,000, Mr.Phuc has received advance 5,000,000. After the technology transfer, if there are complaints about product quality testing (i.e., complaints about the effectiveness of technology)

Ba Huan Private Enterprise ought to have been responsible for keeping test results to ask for expertise or lawsuit to the Court for examination but Ba Huan Private Enterprise unilaterally destructs the entire test results without legitimate reason.

Thus, complaints of Ba Huan Private Enterprise (said that test results are not success) isn’t basis to be accepted.

From 18 to 28 March 2007, Mr.Phuc has conducted technology transfer to Ba Huan Private Enterprise by the processing of test 10 duck eggs-hole in the presence of representatives of Ba Huan Private Enterprise. The testing was completed and the parties have examined the test results. However, at that time, the dispute began because the two parties fail to agree assessment test result: Mr Phuc said that satisfactory results (5/10), and Ba Huan PTE Enterprise for that it doesn’t reach (only 2/5)

Mr.Phuc seals a pending requirement, but Ba Huan PTE Enterprise disagreed and destructed all products tested (10 duck egg-holes) without the consent and presence of Mr.Phuc or representatives of local
